Supreme Court Grants 12 Weeks Maternity Leave to All Adoptive Mothers in Landmark Ruling

In a major step for gender equality, the Supreme Court of India has ruled that all adoptive mothers are entitled to maternity leave.
The court removed an earlier rule that allowed leave only if the adopted child was below three months of age. Now, all legally recognized adoptive mothers can get 12 weeks (3 months) of maternity leave.

What Changed
Before:
Only mothers adopting a child below 3 months could get maternity leave.
Now:
All adoptive mothers are eligible, regardless of the child’s age.
Why the Court Made This Decision
The court said maternity leave is about the process of motherhood, not just childbirth.
It noted that bonding and care are important for every child, whether adopted or biological.
The earlier rule was called arbitrary and unfair, as it denied leave based on a child’s age.
The judges also said that choosing to adopt a child is part of a woman’s right to life and personal freedom.
They pointed out that very few children are available for adoption below three months, making the old rule impractical.

The court also urged the government to introduce paternity leave.
It said childcare is a shared responsibility and not just a woman’s role.
