New Delhi: Opposition MPs have submitted a notice to move a resolution to remove Lok Sabha Speaker Om Birla. They accused him of not allowing Rahul Gandhi and other opposition MPs to speak in the House.
Around 120 opposition MPs signed the notice. The Trinamool Congress (TMC) did not sign it and stayed out of the move.
The MPs also raised objections to the suspension of eight members and cited it as a reason for seeking the Speaker’s removal.

Birla asked Utpal Kumar Singh, the Lok Sabha Secretary General, to examine the notice. He directed him to take action according to parliamentary rules.
The Constitution allows Birla to defend himself in the House if the resolution comes up for discussion.
Congress MP and Chief Whip K Suresh submitted the notice to the Lok Sabha Secretariat. He did so on behalf of the Congress, Samajwadi Party, and DMK.
The Lok Sabha Secretariat will now process the notice under the rules.

What the Constitution says
Article 96 of the Constitution deals with the removal of the Lok Sabha Speaker.
It clearly says that the Speaker cannot preside over the House when a resolution for his removal is under consideration.
During this period, the Speaker also cannot take the Chair for House proceedings.
However, the Constitution allows the Speaker to be present in the House.
It also allows him to speak and defend himself if the resolution is discussed.
This rule applies to both the Speaker and the Deputy Speaker.
