SAN FRANCISCO — April 10, 2025 —
OpenAI is fighting back against Elon Musk, filing a countersuit on Wednesday accusing him of harassing the company and trying to block its growth for his own benefit.
Musk helped start OpenAI back in 2015 but left the company before it became a major force in artificial intelligence. Now, as OpenAI works to switch from a nonprofit to a for-profit company—a move it says is key to raising $40 billion in funding—Musk is trying to stop the transition.
OpenAI’s court filing claims Musk has used everything from online attacks to legal threats to slow the company down. It says Musk has launched “press attacks,” made misleading public statements to his 200 million followers on X (the platform he owns), and even made a fake attempt to buy OpenAI—all in an effort to hurt the company and take control.
“Elon’s nonstop actions against us are just bad-faith tactics to slow down OpenAI and grab the top AI tech for himself,” the company posted on X.
Musk has not publicly responded to the countersuit, and his legal team hasn’t made a comment either.
The fight goes back to last year, when Musk sued OpenAI and CEO Sam Altman, claiming they had abandoned the company’s original mission to build AI for the good of humanity—not for profit. OpenAI and Altman deny those claims, saying the switch to a for-profit model is necessary to raise the money they need to stay competitive in the fast-moving AI race.
Earlier this year, Altman turned down a $97.4 billion buyout offer from a Musk-led group with a simple “no thank you.”
Meanwhile, Musk’s new AI company, xAI, recently bought the social media platform X in a deal worth $33 billion, allowing X’s investors to share in xAI’s future value.
The legal battle is set to go to trial next spring.
